To perform well the state management of lands to contribute to socio-economic, urban growth

In recent years, Binh Duong province has implemented the state management of lands in the province and achieved important results, contributing to meeting the target of socio-economic, urban growth.

To ensure the planning on schedule

According to reports, up to now Binh Duong has basically completed the advisory and issued documents detailing the enforcement of Land Law, contributing to creating legal foundation for all levels, sectors to serve land users. The elaboration and adjustment of land use planning and plans of the province was done on schedule and in line with provisions of Land Law. After land use planning and plans of province- and district- level were approved by competent agencies, functional agencies publicized and organize the strict implementation plans according to regulations.

The formulation of land use planning and annual land use plans are publicly announced and collected people’s opinions through mass media, conferences, and meetings. In addition, land use criteria of district land use planning are in line with provincial plan; targets approved in annual land use plans are consistent with norms of land use planning.

Results of the implementation of land use targets from 2015 to present showed that Provincial People's Committee issued 27 approval decisions and 18 decisions to adjust annual land use plans at district level to ensure the legitimacy of land recovering, allocating, leasing and land use purpose changing. In 2015, the province reduced 6,526ha of agricultural land to shift to non-agricultural land to satisfy the land fund for investment in socio-economic infrastructure projects in the province. In 2016, total area of ​​agricultural lands in the whole province decreased by 542.9ha to shift to non-agricultural lands; In 2017, total area of ​​agricultural lands continued to decrease by 478.6ha to non-agricultural lands.

To stimulate socio-economic development

Land allocation, acquisition, lease and land use purpose change have been carried out by the province in accordance with laws. From July 1, 2014 to December 31, 2017, the province executed land allocation, acquisition, lease and land use purpose change for 563 organizations, corresponding to a total area of ​​2,748ha. With regard to land acquisition for project development, in 3 years from 2015 to 2017, the whole province recovered 1,812ha of land for 416 works and projects. The issuance of land use right certificates was well implemented by localities, contributing to the building of a complete and modern land database serving multi-sectors and multi-purposes. At present, the granting rate of land use right certificates to organizations and individuals in the province is 99.8%.

Regarding land compensation, support and resettlement, policies and regulations of the Central Government have been concretized by Provincial People's Committee in accordance with the actual situation. Legal documents promulgated by Provincial People's Committee have significantly remedied shortcomings and difficulties in actual works, increasing the people’s satisfaction; thereby facilitating the work of recovering and resettlement. Good news is that the work of resettlement, compensation and resettlement is thoroughly regulated and ensure fairness, transparency and objectivity of projects to avoid arising complaints, complex litigation. It has received the agreement of people, whose land is recovered, helping the government accelerate land clearance for the project implementation in the area.

In addition, the price list of land categories issued by the province has been applied stably for 5 years and was adjusted when necessary, creating the legal basis for land finance in the province. The land price list promulgated by the province ensures that the revenue from lands tends to increase, contributing significantly to provincial budget, to socio-economic growth of the province.

There are still some limitations

Besides good results, the enforcement of Land Law 2013 in the province still had some shortcomings in the compensation and clearance in a number of projects; judicial land acquisition process was long. Namely, the implementation of land valuation in accordance with Land Law 2013 was still slow; the duration of land price, in some cases, was still long and did not timely meet progress requirements for calculation of land use levy, land rent, compensation for land recovery. In addition, the determination of reserve price for auctions of land use right when the State allocates or leases land is complicated; Investigation and surveys of market prices of lands for deciding specific land prices were difficult, because by land price informants (land use right transferors or receivers) did not sign the questionnaire to confirm provided information about the land price. At the same time, compensation and clearance of some projects was still prolonged, thus affecting the progress of projects.

According to PPC, the reason for the above shortcomings is that the sensitivity and complication in land sector, while land policies and laws regularly change; instructing documents of the Central Government have not yet been timely promulgated. In addition, provisions of land law relating to the application of land valuation methods in some cases are complex and not suitable to local conditions, for example, lack of market price information, insufficient counseling staff to meet demands. In addition, the price frame of agricultural lands is not appropriate, lower than common transfer prices in the local market (especially for agricultural land in wards, towns, urban centers ...)
