Binh Duong Provincial People’s Committee has just issued Decision No. 44/2014/QD-UBND on regulations of local water resource management. The Decision is applicable to State’s agencies, organizations, and individuals working in the water resources-related fields including drilling for underground water, information system and database of water resources, reports on exploitation of water resources, registration of exploiting underground water, foundations for licensing, procedures and processes of licensing the survey, exploitation, and use of water resources and waste release to waterways, etc.
The regulations clearly rules on non-licensing water resource use in families, in production activities of less than 10 cubic meters of water use per day night, in surface water for agriculture and aquacultivation of flow less than 0.1 cubic meters per second, in surface water used for non-agricultural activities of less than 100 cubic meters of water per day night, in using surface water for power generation of capacity less than 50 kW, in servicing cultural, religious, scientific researching, fire fighting, pollution and disease responding, and other emergency circumstances in accordance with the laws.
Waste water releasing to water sources not to be registered includes waste water from families, waste water from production facilities of less than 5 cubic meters releasing per day night but not including facilities of dying, printing, and detergent treatments in garment making, of metallurgy, metal recycling and plating, electronic parts, industrial waste recycling, taning and leather recycling, chemicals used mineral processing, oil filtering and processing, production of paper, paper pulp, rubber latex, detergents, additives, fertilizers, chemicals, medicines, etc. which require the facilities to be licensed with water waste releasing to the water sources.
The above regulations stipulate on terms of 5-year license for surface water use with extension to be offered every 3 years; of 2-year license for underground water survey with extension to be offered once but not exceeding 1 year, 5-year license for underground water use with multiple extension to be offered for 2 years at most for each extension.
Article 13 of the Decision and Articles 18 and 20 of government’s Decree No. 201/2013/ND-CP detailing implementation of some articles of Law on Natural Resources shall govern the licensing of survey, exploitation and use of water resources and waste water releasing.
