Professionalism and conformity depicted by the establishment of land registry

That was the statement of Mr. Pham Thanh Tung, Director of Land Registry under Department of Natural Resources and Environment (DONRE) on talking to reporter of Binh Duong Newspaper. The establishment conforms with Land Law 2013, government’s Decree No. 43/2014/ND-CP dated May 15, 2014 and the decision of boosting administrative reforms in land-related matters.

Reporter: Sir, please make us informed of the purpose of the Land Registry.

Mr. Pham Thanh Tung: The Land Registry (one level only) under DONRE was established by our new policies and approaches of organization reforms to meet the demands for State management and convenience of organizations and individuals in accessing and implementing administrative procedures for land management in conformity with modern and current technology. Actually, for the time, the Land-use Right Registry of the province and/or districts, towns, and Thu Dau Mot City have been in good shape, significantly, contributing to State management of natural resources and environment locally. However, limitation and shortcomings remained due to non-uniformed procedures in different offices, the delay of document processing, the non-uniformed updating and amending of cadastre profiles at 3 levels of the province, districts, and communes.

As the matter of fact, the establishment of one-level Land Registry in Binh Duong Province is conformed with major breakthroughs and upholding of professionalism in organization and implementation of land registration, certificate issuing, concentrated management and organization, easy procedure resolution for land registration and properties on the land, improved process of certificate issuing, and shorter paper burden.

Reporter: Sir, how effective are the operations?

Mr. Pham Thanh Tung: In over 1 month of operation, Land Registry and its branches have been in stable operation. Thanks to prior preparation, the operations have been basically established in terms of organization, designation, and assignments. In the meantime, the Land Registry also makes consultancy and submission to Binh Duong Provincial People’s Committee through issuing Decision No. 13/2015/QD-UBND dated April 14, 2015 stipulating on some matters related to land registration procedures, properties on the land, land-use right certificate, ownership of houses and properties on the land, detail regulations on functionality of the registry and its branches to ensure regulation observation and thorough management. The new stipulation ensures the improvement of unified procedures and reduce time of document and procedure processing than before.

Besides, we are boosting the land database construction so that our branches will be updated with land fluctuation in the province. By issuing accounts, the document management software should work to transfer the data amongst the branches and the head registry and then connected to DONRE.

Reporter: And, what challenges the implementation?

Mr. Pham Thanh Tung: We are aiming for simplification of the administrative procedures through the one-level Land Registry to facilitate administrative procedures regarding land matters in the registry and its branches; however, we are facing certain problems due to different process of document acceptance and processing for the contacting people.

Up to date, we have foreseen and resolve the problems by special contract with the courier to return the land documents as fast as possible. The documents from Thu Dau Mot City, Ben Cat Town, Thuan An Town and those locality near the registry will be sent directly to the registry without affecting the processing time. On the other hand, we send such information to tax departments for the determination of financial obligations before printing cadastre certificate to be submitted to DONRE leaders for signing. As the land users fulfill their financial obligation in the process, they can gain their land-use certificate.
