The Government issued Decree No. 32/2024/ND-CP on the management and development of industrial clusters, replacing Decree No. 68/2017/ND-CP and Decree No. 66/2020/ND-CP.
Decree No. 32/2024/ND-CP takes effect from May 1, 2024. The Ministry of Industry and Trade also issued Official Dispatch No. 1817/BCT-CTDP to People's Committees of provinces and centrally-controlled cities on the management and development of industrial clusters.
Phu Chanh Industrial Cluster
There are currently 7 industrial clusters in Binh Duong, with stable infrastructure and an occupancy rate of over 60%. The development of industrial clusters has affirmed its important role in socio-economic development in localities, contributing to economic restructuring by increasing the proportion of industry (especially in rural areas), creating jobs and stable income for a part of the workforce in the area. However, during the implementation process, there were also some inadequacies and uncertainties in applying the law in practice. Therefore, the province has proposed to eliminate obstacles for investors.
The Ministry of Industry and Trade pointed out some focuses for implementation in the coming time as follows:
1. While Decree No. 32/2024/ND-CP has not yet taken effect, it is recommended to continue to strictly implement the management and development of industrial clusters according to the provisions of Decree No. 68/2017/ND-CP and Decree No. 66/2020/ND-CP and related laws.
2. Based on the powers and responsibilities prescribed in Decree No. 32/2024/ND-CP, the People's Committees of provinces and centrally-controlled cities proactively organize the implementation of the Decree's provisions.
3. Regarding the industrial cluster development plan under the Provincial Planning for the period 2021-2030, with a vision to 2050:
- For localities whose Provincial Planning has not been approved, it is recommended to coordinate with relevant agencies to complete and submit to the Prime Minister for approval urgently.
- For localities with approved Provincial Planning, during the process of planning and organizing the implementation of the Industrial Cluster Development Plan in the area, it is recommended to:
+ Review the Industrial Cluster Development Plan during the planning period to ensure complete information for each Industrial Cluster (including: name, location, area, operating lines, technical infrastructure investment progress) according to Decree No. 66/2020/ND-CP; ensure feasibility, synchronization, consistency and no overlap with other plans in the area. In case the Industrial Cluster Development Plan under the approved Provincial Plan does not have enough information as prescribed or overlaps with other plans in the area, People's Committee at province-level shall direct the handling or report to the competent authority for handling according to regulations.
+ Develop a specific plan to implement the Industrial Cluster Development Plan for the period 2021-2030 to ensure feasibility; sufficient land fund to establish and invest in developing industrial clusters in the list according to the approved planning schedule.
+ For industrial clusters withdrawing from planning: Have feasible management solutions and conversion plans in accordance with relevant laws; In particular, pay attention to strict management of the environment, social security and order, fire and explosion prevention, ensuring the legitimate rights and interests of relevant businesses, organizations and individuals.
3. Direct investment promotion, attraction and selection of businesses with sufficient capacity and experience as investors for industrial cluster technical infrastructure. Orient and prioritize the promotion of businesses/secondary investment projects with the same industry and capacity to link and support each other in the same industrial cluster; industrial sectors, according to the Provincial Planning orientation, have high technology, are clean, consume little energy, bring high added value, and develop sustainably in the industrial cluster.
4. Regularly review the investment progress in building technical infrastructure (noting that industrial clusters must have environmental protection infrastructure according to regulations), attract investment into industrial clusters in the area to have solutions to overcome difficulties, speed up investment progress, promote efficiency; completely handle industrial clusters and projects in industrial clusters that cause environmental pollution, ineffective land use, improper purposes, and slow progress.
5. Strengthen inspection, examination, and handling of legal violations at industrial clusters in the area (such as: Laws on land, investment, construction, environmental protection, fire prevention and fighting and other relevant laws) to rectify the management, investment and development of industrial clusters in the province in accordance with the provisions of law.
