Unemployment insurance subjects to be expanded from and on January 1

From and on January 1, 2015, employees shall have more opportunities to pay for unemployment tax policies. Previously, before 2014, unemployment insurance policies were only applicable to establishments of more than 10 employees and those employees of employment contracts of over 12 months working. Now, those establishments of less than 10 employees and those employees of over 3 months working under employment contracts are able to pay for unemployment insurance policies.

“The expansion of subjects to unemployment insurance policies is under expectation and needs of enterprises and the employees as over 5 years of unemployment tax regulations, we are now able to manage stable unemployment tax policies to create equality of employees beneficiary of social policies,” said Mr. Bui Huu Phong as Director of Provincial Social Insurance as talking to Binh Duong Newspaper reporters.

- Sir, to be benefited by unemployment insurance, what conditions should the employees meet? Upon quitting, what is the term of filing for unemployment insurance benefits and in what amounts?

- To be benefited with unemployment insurance, the employees should meet the following conditions: legal employment contract termination, full payments to unemployment policies before employment termination for twelve months and more within twenty four months before employment terminations (applicable to employees of employment contracts of twelve months and more), full payments to unemployment policies before employment termination for twelve months and more within thirty six months before employment terminations (applicable to employees of employment contracts of three months and more), not employed after 15 days from the date of filing for unemployment insurance policies filing to Binh Duong Provincial Job Introduction Center or its branches in Di An Town, Ben Cat Town, and Tan Uyen Town.

Before December 31, 2014, we have to register and file the documents at the same time; now, registration was abolished but document filing which should be within 3 months from the date of employment termination. The unemployment insurance benefit based on premium payments and time: Monthly benefit of unemployment insurance policies is equivalent to 60% of average salary of 6 consecutive months before employment termination. The term of receiving unemployment insurance benefits based on months of premium payments: 3 months of unemployment allowances for unemployment insurance policy premium payments of twelve to thirty six months. After such conditions are met, every twelve months of premium payments should yield additional 1 month of unemployment allowances but not more than twelve months added up.

- Previously, unemployment benefit payments should become one-time payments to the unemployed upon accepting new job. What is the situation now, sir?

- Previously, one-time payments of unemployment for remaining months was to encourage employees to seek for new jobs; however, we should understand that new job means no more unemployment allowances; this is right to the nature of unemployment and international practice. In the event that during the months of accepting unemployment allowances, the unemployment status ceases, then, the remaining months for insurance payments shall be preserved and added to later payments to unemployment insurance policies.

- Sir, aside from unemployment insurance, what other allowances should the unemployed earned?

- According to Article 42 of Law on Employment, governing unemployment insurance policies, unemployment allowances, job introduction and consultancy support, training support to maintain and sustain working skills for the employees who are issued with medical insurance card during the stage of earning unemployment insurance benefits are included.
