Individuals allowed to let off fireworks from next year

Vietnamese citizens who have full civil act capacity shall be allowed to let off fireworks on multiple occasions from January 11, 2021, according to Government’s latest Decree.

Decree No. 137/2020/ND-CP on the management and use of firecrackers and fireworks shall come into effect from January 1, 2021.

The Decree stipulates that agencies, organizations, and individuals that have full civil act capacity shall be allowed to use fireworks in the following cases: holidays, birthdays, weddings, conferences, opening ceremonies, anniversaries, and cultural and artistic activities.

They can only buy fireworks from organizations and enterprises that are licensed to produce and sell fireworks.

Centrally-run cities and Thua Thien-Hue Province shall be allowed to conduct display of high-altitude and low-altitude fireworks within 15 minute during the Lunar New Year festival.

Other localities shall only be allowed to display low-altitude fireworks with the same period of time.

On the occasion of the Hung Kings’ death anniversary, the northern province of Phu Tho shall be allowed to display low-altitude fireworks at 9pm on the 9th day of the 3rd lunar month.

On the occasion of the National Day, centrally-run cities and Thua Thien-Hue shall be allowed to display high-altitude and low-altitude fireworks.

Other localities shall only be allowed to display low-altitude fireworks.

On the occasion of the Victory Day (April 30), Ha Noi and Ho Chi Minh City shall be allowed to display high-altitude and low-altitude fireworks at 9:00 pm on April 30.

On the occasion of Dien Bien Phu Victory Anniversary, the northern province of Dien Bien shall be allowed to display low-altitude fireworks in Dien Bien city at 9:00 pm on May 7.

The following acts shall be strictly banned: researching, manufacturing, buying, selling, exporting, importing, storing, transporting, using, or appropriating firecrackers, except for organizations and enterprises under the Defense Ministry that are assigned by the Prime Minister to research, produce, import, export, supply, transport and use fireworks.

Earlier in 1994 when the use of fireworks was rampant, causing many deaths and injuries and annual losses of tens of billions of dong, the Government passed a law prohibiting the production, distribution and use of firecrackers and explosive chemicals./.
